Let s start with Chapter 1 s explanation 00:04:24.970 --> 00:04:33.160 of remediation and how it is applied in practice. Look at the definition in the box on the screen. 00:04:33.160 --> 00:04:37.840 Remediation is the process of correcting a wrong, or grievance, after this 00:04:37.840 --> 00:04:42.970 wrong or violation is uncovered, investigated, and verified by the grievance 00:04:42.970 --> 00:04:47.290 mechanism. When we refer to a wrong or grievance 00:04:47.290 --> 00:04:52.930 in assess-and-address, we are talking about human rights harms: child labor, 00:04:52.930 --> 00:04:59.540 forced labor, discrimination, and workplace violence and harassment. 00:04:59.540 --> 00:05:05.060 Remediation as a process is applied in two different actions: we call 00:05:05.060 --> 00:05:11.590 these corrections and corrective actions. You'll see these terms mentioned 00:05:11.590 --> 00:05:18.870 regularly in the Remediation Protocol. A correction is an immediate response 00:05:18.870 --> 00:05:25.130 to stop harm and it should happen within 12 weeks of a case being identified. 00:05:25.130 --> 00:05:30.740 A corrective action is a long-term response to tackle the root cause of the 00:05:30.740 --> 00:05:35.800 harm and to prevent it from being repeated. Let's look at some examples of 00:05:50.040 --> 00:05:56.540 corrections and corrective actions. We'll imagine a case of child labor. 00:05:56.540 --> 00:06:03.389 Kwame is 13 years-old and he has been helping his father with lots of tasks on the 00:06:03.389 --> 00:06:05.960 farm. A person who is monitoring child labor risks 00:06:05.960 --> 00:06:08.860 sees him working with a sharp knife in the harvest 00:06:08.860 --> 00:06:12.860 and also lifting heavy sacks. This is banned for children. 00:06:12.860 --> 00:06:19.200 Kwame is also working during school hours. The investigation reveals that the family 00:06:19.200 --> 00:06:23.310 use Kwame because they cannot afford to hire anyone else. 00:06:23.310 --> 00:06:28.870 If you stop Kwame from working, his younger brother will have to work instead. 00:06:28.870 --> 00:06:33.730 Kwame s school is quite far away and the family find it difficult to pay for transport 00:06:33.730 --> 00:06:41.720 and other school fees for both brothers. The challenge is how to correct this situation? 00:06:41.720 --> 00:06:46.880 Your first priority is to keep Kwame safe (we ll talk about this in a bit more depth 00:06:46.880 --> 00:06:51.070 shortly). You work with his family to identify tasks 00:06:51.070 --> 00:06:54.710 that he can do to help out on the farm that are safe and 00:06:54.710 --> 00:06:59.030 age-appropriate, and that do not interfere with his schooling 00:06:59.030 --> 00:07:04.250 and you work with the teacher to ensure that he can go to school. 00:07:04.250 --> 00:07:08.340 You will also do more monitoring in the area to check there are no other families 00:07:08.340 --> 00:07:13.770 and children in the same situation. This is the correction addressing the immediate 00:07:13.770 --> 00:07:18.530 risk to Kwame. In the long-term, you need to tackle the root 00:07:18.530 --> 00:07:22.170 cause leading Kwame to work, which is poverty and 00:07:22.170 --> 00:07:25.010 the fact that the family cannot make a sustainable livelihood 00:07:25.010 --> 00:07:29.750 out of the crop. You work with the family and local or farm 00:07:29.750 --> 00:07:34.639 experts to find ways to improve farm or crop productivity, 00:07:34.639 --> 00:07:40.990 or to diversify other forms of income so that the family is less reliant on child labor. 00:07:40.990 --> 00:07:46.060 You also work with the family and local teacher to address the other reasons preventing Kwame 00:07:46.060 --> 00:07:49.690 from going to school, such as school fees, distance, 00:07:49.690 --> 00:07:54.729 and transport, and to improve the family's understanding of the long-term benefits to 00:07:54.729 --> 00:08:00.680 the household of education. This is a corrective action addressing 00:08:00.680 --> 00:08:07.970 the root cause of child labor so that you prevent it from recurring. 00:08:07.970 --> 00:08:12.710 Chapter 2 of the Protocol sets out the principles of remediation. You can see them 00:08:12.710 --> 00:08:17.020 here on screen. There are three and they are very simple: 00:08:17.020 --> 00:08:20.970 First, put the affected person's welfare, safety, 00:08:20.970 --> 00:08:26.479 and best interest first when you plan any type of remediation action. 00:08:26.479 --> 00:08:30.490 Second, always act in accordance with national law, 00:08:30.490 --> 00:08:35.020 the Rainforest Alliance standard, and international human rights principles, when 00:08:35.020 --> 00:08:40.240 you plan remediation. And third, ensure that your remediation 00:08:40.240 --> 00:08:46.070 actions include actions to prevent repetition of the harm. 00:08:46.070 --> 00:08:48.700 Let's look at that first principle in more depth 00:08:48.700 --> 00:08:56.310 putting the affected person s welfare, safety, and best interest first. 00:08:56.310 --> 00:09:03.950 One of the principles and a key step in remediation is to safeguard the person who has been affected. 00:09:03.950 --> 00:09:08.540 That could mean keeping them safe from someone who is hurting or threatening them 00:09:08.540 --> 00:09:13.149 for example in a case of workplace violence or harassment. 00:09:13.149 --> 00:09:18.330 It can also mean protecting their identity for example, you shouldn't share the names 00:09:18.330 --> 00:09:21.920 of affected persons with anyone outside the committee 00:09:21.920 --> 00:09:29.100 or who isn't directly involved in remediation, monitoring or mitigation of this case. 00:09:29.100 --> 00:09:35.410 It means seeking the affected person s consent before initiating remediation if you are dealing 00:09:35.410 --> 00:09:39.100 with a child, you ask the parent or caregiver as well as 00:09:39.100 --> 00:09:44.050 the child. It also means ensuring that your corrections 00:09:44.050 --> 00:09:47.570 and corrective actions put their best interests first. 00:09:47.570 --> 00:09:51.990 In some cases that can be quite challenging, 00:09:51.990 --> 00:09:56.160 especially in child labor. Let s go back to our imagined case 00:09:56.160 --> 00:10:04.450 with Kwame and consider his best interest. Previously we talked about a whole set of 00:10:04.450 --> 00:10:07.510 corrections and corrective actions that could be 00:10:07.510 --> 00:10:11.880 applied to remediate Kwame s case of child labor. 00:10:11.880 --> 00:10:14.630 Looking just at the issue of work can help us to 00:10:14.630 --> 00:10:19.770 think about what acting in Kwame's best interest means. 00:10:19.770 --> 00:10:22.960 We know that at present, Kwame's family have no other option 00:10:22.960 --> 00:10:25.980 available to them but to rely on his work to help 00:10:25.980 --> 00:10:29.940 supplement the family income. Without his help, 00:10:29.940 --> 00:10:33.430 there may be insufficient food to provide adequate nutrition 00:10:33.430 --> 00:10:38.279 or shelter for the children. Also, if Kwame stops working, 00:10:38.279 --> 00:10:44.570 his little brother may have to start. Clearly, banning Kwame from working is not in his 00:10:44.570 --> 00:10:50.130 best interest nor his sibling s. Teaching Kwame and his parents what tasks 00:10:50.130 --> 00:10:55.440 he can do to help, which are safe and age-appropriate and after 00:10:55.440 --> 00:10:59.650 school hours - is considering his best interests. 00:10:59.650 --> 00:11:03.279 This correction enables him to continue to help his family, 00:11:03.279 --> 00:11:09.640 while gaining important skills and experience, without putting himself at risk 00:11:09.640 --> 00:11:16.470 and enables him to go to school. The Protocol also contains a list of all 00:11:16.470 --> 00:11:21.060 the required actions that you must take to remediate harm. 00:11:21.060 --> 00:11:25.550 This is in Chapter 4. There are five mandatory steps 00:11:25.550 --> 00:11:31.640 1) immediate safeguarding and seeking consent, 2) conducting a severity test, 00:11:31.640 --> 00:11:36.790 3) implementation of corrections and development of a corrective action plan, 00:11:36.790 --> 00:11:40.371 4) implementation of the corrective action plan, and 00:11:40.371 --> 00:11:45.060 5) monitoring. As you can see, the grievance committee plays 00:11:45.060 --> 00:11:48.220 a key role in investigation and testing the 00:11:48.220 --> 00:11:53.570 severity of a case. Your role in assess-and-address is to coordinate 00:11:53.570 --> 00:11:57.100 with them on safeguarding and to develop and implement 00:11:57.100 --> 00:12:01.620 the remediation response. And you'll also coordinate with the gender 00:12:01.620 --> 00:12:04.910 committee or person where the case concerns women or 00:12:04.910 --> 00:12:09.490 girls who have specific concerns around gender 00:12:09.490 --> 00:12:12.350 You need to take note of these mandatory steps 00:12:12.350 --> 00:12:15.890 who is responsible for them, and how long they should take - 00:12:15.890 --> 00:12:22.269 because you should take these steps for every case that you remediate. 00:12:22.269 --> 00:12:29.230 Let's return to our imaginary case and Kwame to review these mandatory steps in practice. 00:12:29.230 --> 00:12:32.160 We start with a person who is monitoring child labor 00:12:32.160 --> 00:12:35.100 reporting Kwame s case to the assess-and-address committee, 00:12:35.100 --> 00:12:39.650 who then immediately inform the grievance committee. 00:12:39.650 --> 00:12:45.529 After considering Kwame's situation, the assess-and-address committee and grievance committee agree that 00:12:45.529 --> 00:12:49.250 there are no emergency safeguarding needs and they ask 00:12:49.250 --> 00:12:52.510 Kwame and his parents for their consent to remediation, 00:12:52.510 --> 00:12:57.260 which they give. The grievance committee assesses the case 00:12:57.260 --> 00:13:02.340 and the severity. They verify that it is child labor and recommend 00:13:02.340 --> 00:13:06.240 remediation. The assess-and-address committee then works 00:13:06.240 --> 00:13:10.830 with Kwame's parents and the teacher to develop and implement both 00:13:10.830 --> 00:13:16.410 the immediate corrections (to keep Kwame safe) and the longer-term corrective 00:13:16.410 --> 00:13:19.620 actions (to help prevent Kwame and his siblings from 00:13:19.620 --> 00:13:22.950 child labor and to enable them to go to school). 00:13:22.950 --> 00:13:28.810 Over time, the committee also regularly monitors Kwame s case, 00:13:28.810 --> 00:13:31.130 keeping in touch with the family and teacher, and 00:13:31.130 --> 00:13:36.750 assessing whether the remediation actions are working or need adapting. 00:13:36.750 --> 00:13:39.670 The assess-and-address committee record when each of the 00:13:39.670 --> 00:13:46.350 5 mandatory steps is complete in Kwame's case. There are three key steps which are set out 00:14:22.300 --> 00:14:27.149 in the Protocol. First map your stakeholders - decide who can help 00:14:27.149 --> 00:14:31.940 Second, Write down the remediation plan - identify who does what 00:14:31.940 --> 00:14:36.310 Third, provide training and awareness to 00:14:36.310 --> 00:14:45.010 those involved in implementing the plan Your first step is to identify who can support 00:14:45.010 --> 00:14:49.480 remediation. That means who has the skill and experience 00:14:49.480 --> 00:14:52.070 to assist with the four particular human rights 00:14:52.070 --> 00:14:54.470 harms that you may have to address 00:14:54.470 --> 00:14:59.709 child labor, forced labor, discrimination, and workplace violence and harassment. 00:14:59.709 --> 00:15:02.959 We call these people stakeholders, and you may already have 00:15:02.959 --> 00:15:09.430 identified them when seeking support for risk mitigation, or for monitoring. 00:15:09.430 --> 00:15:12.640 We recommend that you think about who can help at three levels 00:15:12.640 --> 00:15:18.019 First, at the farm level: people who are at or connected 00:15:18.019 --> 00:15:23.110 to the farm or group in some way (like trainers, workers, union members, 00:15:23.110 --> 00:15:27.750 cooperative members, lead farmers, gender committee members etc) 00:15:27.750 --> 00:15:32.020 Second, at the local level: people in the local community 00:15:32.020 --> 00:15:36.060 or area such as labour providers, child protection officers, 00:15:36.060 --> 00:15:41.180 faith and community leaders, teachers, or women s group leaders. 00:15:41.180 --> 00:15:45.290 And third, at the district / provincial / national level: 00:15:45.290 --> 00:15:50.050 relevant government officials, perhaps department of education staff, 00:15:50.050 --> 00:15:55.450 experts in farming or migration, healthcare workers or NGO experts in relevant 00:15:55.450 --> 00:16:00.220 topics.
